The foreign investor must purchase an existing business with plans to expand or reorganize. The investor must also create 10 new full-time positions and invest a minimum of $1.8 million.

Permanent residency is granted to the main applicant and their immediate family members.

Abandoned or neglected immigrant children have a chance of obtaining a Green Card in the United States.

Undocumented immigrants under the age of 21 and abandoned or neglected by their parents may be eligible for a status legalization program called SIJS (Special Immigrant Juvenile Status.)

If approved, the minor is granted permanent resident status, allowing them to live, work, study, and build a life in the United States.

To be eligible for SIJS the minor must have been declared dependent in a juvenile court and prove that it is not in their best interest to return to their home country.

Available options depend on the individual’s circumstances, such as age, form of entry, U.S. born family members, and existing immigration programs criteria.

NYC IMMIGRATION Q&A

The United States offers immigrant and nonimmigrant visas. Immigrant visas allow individuals to stay indefinitely in the U.S. by granting them a Green Card, or permanent residency. Green Card holders can later become U.S. citizens through the naturalization process. Nonimmigrant visas are granted for specific purposes and lengths of stay. For example, a business trip, tourism, studies, medical treatment, or work.

Depending on your eligibility you may get an immigrant or nonimmigrant visa. If you are a Green Card holder you may live anywhere in the U.S., including New York City. However, you may also live in New York City if you’re here for a short period of time on a work, study, or another temporary visa.

The type of nonimmigrant visa you may be eligible for depends on the purpose of your travel. For example, individuals with extraordinary talent in the sciences, arts, education, business, or athletics may be granted an O visa. While an intra-company transferee would be granted an L visa. To live In NYC and the rest of the United States, you can apply for nonimmigrant visas for multiple reasons, including tourism, sports competitions, studies, business activities, medical treatments, cultural exchanges, and many other purposes.

If you already have a visa that allows you to work in the United States, all you need is a work permit. If that is not the case, you could be granted an L visa if you’re transferring to a U.S. office from an overseas branch of the same company. You may be granted an H1B visa if sponsored by a U.S. employer. You could get an O visa if you have an extraordinary talent in the sciences, arts, education, business or athletics to perform such professional activity in the United States. Or you could get an EB visa if you are an investor.

According to data shared on the MOIA's 2020 Annual Report, 13.4% of the foreign-born population in NYC comes from the Dominican Republic, making it the largest immigrant group in the city. This group is followed by China with 11.8% and Jamaica with 5.7%.

There are more than 20 different categories of nonimmigrant visas available for visitors coming to the US temporarily. For people going to reside permanently in the United States, there are a lot more different sorts of immigrant visas. Your intended travel's purpose will decide what kind of visa you require.

Your authorized period of stay will be noted on your admission stamp or paper Form I-94, also known as an Arrival/Departure Record, if the Department of Homeland Security, Customs and Border Protection Immigration Officer at the port-of-entry admitted you into the United States for a specific period of time. Even if your visa expires while you are in the country, you will be allowed to stay there for the duration of your permitted stay.

After the visa applicant has been interviewed by a consular officer, certain visa applications need to go through further administrative processing, which takes time.

Your payment was an application fee. This charge, which covers the cost of processing your application, is required of every person who applies for a U.S. visa, regardless of where they are in the globe. Regardless of whether you receive a visa or not, this cost is non-refundable because your application was completed successfully.

You need to get in touch with the Immigrant Visa Unit of the American Consulate or Embassy that issued your visa. You do not have to submit a fresh petition to USCIS, but you may need to submit a fresh application (DS-260) and pay a second processing fee for an immigrant visa application.

Entry into the United States is not guaranteed by a visa. A visa enables a foreign national to enter the country, and a U.S. Customs and Border Protection (CBP) immigration inspector from the Department of Homeland Security decides whether or not to grant access.

You will need to seek a new visa in the U.S. Embassy or Consulate overseas if your original visa has been destroyed in any form.

You must get them replaced right away if your paper Form I-94 or passport with your admissions stamp is lost or stolen.

Burroughs visas, which are manually stamped on a traveler's passport for tourism or business purposes, have an indefinite validity period and are good for ten years. All Burroughs visas with an indefinite validity period became null and invalid on April 1, 2004. As a result, in order to travel to the United States with an indefinite validity visa, you must apply for a new visa.
